WisPolitics.com reports that the appeals court rejected a motion from Atty Gen JB Van Hollen to withdraw his appeal over Dane County Judge Maryann Sumi's temporary restraining order barring the publication of the collective bargaining bill.

The appeals court says Van Hollen should ask the State Supreme Court to rule on his motion, since the appeals couort has asked the Supremes to hear the case directly.

Will that put Justice David Prosser on the spot the week before the election? Could be very interesting. Will Prosser try to prove his "independence" and vote against the Walker administration, or will he do what comes naturally and "complement" what Walker and the Fitzgerald boys do?
